ان ظاهرة النزوح من الظواهر الانسانية القديمة في العمق في تاريخ المجتمعات البشرية، حيث عرفت المجتمعات البشرية القديمة هذه الظاهرة من خلال التدفقات البشرية الجماعية كانت او الفردية والتي كان يقوم بها الناس هربا من الجوع او الخوف او الاعتداء من مكان الى اخر بحثا عن ملاذ امن.

The phenomenon of displacement is one of the ancient human phenomena that goes deep into the history of human societies. Ancient human societies knew this phenomenon through human flows, whether collective or individual, which people carried out to escape hunger, fear, or assault from one place to another in search of a safe haven.

يسعى الباحث في دراسته إلى بيان حقوق اللاجئين في الشريعة الإسلامية وقد تناول البحث حقوق اللاجئين منها حق الإقامة والتنقل والعمل، وحق اللاجئ في دخول دار الإسلام والإقامة فيها قدر الحاجة أو المصلحة، وحق اللاجئ في حفظ دينه، وحق اللاجئ في حفظ نفسه، وحق اللاجئ في حفظ عقله، وحق اللاجئ في حفظ عرضه، وحق اللاجئ في اتخاذ السكن المناسب له والإقامة فيه، وحق اللاجئ في التعامل والملكية، وحق اللاجئ في الحرية الشخصية، وحقه في استقدام أسرته وأمواله، وحق اللاجئ في التعليم، وحق اللاجئ في التقاضي أمام المحاكم في الفقه الإسلامي، وذلك في ظل الشريعة الإسلامية. ولقد نهج الباحث في دراسته المنهج المقارن والمنهج الاستقرائي في رصد المعلومات ذات الصلة بالموضوع، ثم حللها تحليلاً دقيقاً وفق المنهج المقارن وذلك حسب المعلومات الواردة في المصادر الأولية والثانوية

أما أسباب اختيار الموضوع كنت عزمت أن أختار موضوعا عصرياً له ارتباط بواقع المسلمين ومشكلاتهم تبادر إلى ذهني "حقوق اللاجئين في الشريعة الإسلامية " وما يرتبط به من مسائل، وبعد بحثٍ في أمهات الكتب الفقهية ظهر لي أن فقهاء المسلمين بحثوا مسألة حقوق اللأجين في الشريعة الإسلامية .

و حتى يخرج البحث بالنتيجة المرجوة منه؛ فقد تناولت فيه مفهوم اللجوء في القرآن الكريم و السنة النبوية، و بينت بعض صور اللجوء في العصور القديمة، ثم بينت أسباب اللجوء في الشريعة و القانون، ثم انتهيت إلى بيان حقوق اللاجئين، و الأمور التي ينتهي بها اللجوء في (الشريعة و القانون) بشيء من التفصيل.

وبما أن مشكلة اللجوء أصبحت مشكلة دولية عامة، خاصة بعد ما تزايدت في السنوات الأخيرة أعداد اللاجئين تزايداً جعل هذه المشكلة أكثر تعقيداً وأبعد آثاراً مما يستلزم إلقاء المزيد من الضوء عليها بياناً للأسباب وتقديماً للمعالجات والحلول.

As for the reasons for choosing the topic, I was determined to choose a modern topic related to the reality of Muslims and their problems. “The rights of refugees in Islamic law” and the issues related to it came to mind. After researching the main books of jurisprudence, it appeared to me that Muslim jurist discussed the issue of the rights of refugees in Islamic law.

In order for the research to produce the desired result, In it, I discussed the concept of asylum in the Holy Qur’an and the Sunnah of the Prophet, and showed some forms of asylum in ancient times, then I explained the reasons for asylum in Sharia and law, then I concluded by explaining the rights of refugees, and the matters that lead to asylum in (Sharia and law) with something. Of detail.

Since the refugee problem has become a general international problem, especially after the number of refugees has increased in recent years, it has made this problem more complex and far-reaching, which requires shedding more light on it, explaining the causes and presenting treatments and solutions.

لقد تطور مفهوم العذر بمرور الزمن الى ظهور نظريات عامة في القوانين الجزائية، كنظرية القوة القاهرة او القوة الغالبة واعتبارها مانعا من موانع المسؤولية الجزائية. فالقوة القاهرة هي ذلك االسبب الاجنبي او القوة الخارجية التي يخضع لها الانسان لا محالة، ولا يمكنه دفعها او مقاومتها وتسخره في ارتكاب فعل او امتناع.

يمثل الجهل حالة نفسية مناطها انتفاء العلم بالقاعدة القانونية الجزائية او الشرعية. وقد يحدث ان يرتكب الشخص وهو متمتع بكامل قواه العقلية تحت تاثير الجهل، سلوكا يحرمه القانون الجزائي. وهذا الجهل قد يكون بالعناصر الاساسية المكونة للجريمة او بظروفها المادية او الشخصية. وينص القانون الجزئي الذي يضفي على السلوك صفة غير مشروعة.

Ignorance represents a psychological state based on the lack of knowledge of the criminal or Sharia legal rule. It may happen that a person, while in full possession of his mental faculties, and under the influence of ignorance, commits behavior prohibited by the criminal law. This ignorance may be about the basic elements that make up the crime or its financial or personal circumstances. It provides partial law that gives the behavior an illegal character.

الجريمة ولدت مع ولادة الانسان حافزها الشيطان والوقاية منها هي مخافة الله كما نصت سورة المائدة اية 28. وشغلت الجريمة الانبياء والمرسلين والعلماء والاوصياء ورجال الدين، شغلت الجميع لانها تصادر الامان وتخلق الفوضى والقلق. فكانت العقوبة هي الرادعة في التشريعات السماوية والوضعية، وذلك لمكافحة انتشار الجريمة وصيانة الفرد والمجتمع

يعد الاعلام الحديث ووسائله المتنوعة واستخداماته هو سمة العصر ومحط اهتمامات المؤوسسات والافراد بمختلف انتمائاتهم واهدافهم واغراضهم المنشودة بهذا الاستخدام وكذلك الرسائل التي تستهدف (القلوب والعقول اولا لغرض التأثير عليها وتغيير انماط التفكير والسلوك والتوجهات العامة وخلق بيئة قيمية واخلاقية جديدة داخل عقل المتلقي وزعزعة ثوابت وايمانات راسخة وخلق حالة من الصراعات الداخلية بين الموروث والمكتسب " ضمن معايير التنشئة والتراكم المعرفي وبين التدفق الهائل من المعلومات والافكار والرؤى التي تجعل عقل المتلقي يعيش بدوامة الصراعات وتبدا حالة التشكيك والخوف والقلق المستقبلي على جميع الاصعدة من خلال المحركات الاعلامية الهائلة والتي تضخ بهذه الرسائل الملغومة والمختبئة تحت عباءات متعددة ومختلفة وتنقسم بين رسائل خفية ومكشوفة ومصنوعة بحرفية وتقنية عالية وعناية مقصودة لاستهداف العقول الرخوة وغير الرخوة وتنطوي الكثير منها على قصدية شن حروب يطلق عليها بالحروب النفسية والسياسية او حروب العقول وهي قديمة ولكن آلياتها وادواتها تتجدد بتجدد الثورة التقنية والفكرية المعاصرة.

يعتبر المال من المصالح الجوهرية التي تقتضي الحماية في القوانين الوضعية والشريعة الاسلامية، لان المال لاغنى عنه لاستمرار الحياة، والشريعة الاسلامية جعلت منزلة الذي يُقتل دفاعاً عن ماله شهيدا . ان الاستيلاء على اموال الافراد سواء كان بدون رضا المالك كالسرقة ، أو يكون برضاه باستخدام الغش أو الخداع أو التدليس أو خيانة الأمانة أو الاحتيال، ماسة بامان المجتمع واستقراره ،ولهذا فان الجرائم المالية تؤدي الى انهيار العديد من المجتمعات وتفككها وتخلفها.بسبب عجز المشرع وعدم جديته للوقاية منها. وما يساهم في زيادة الجرائم المالية هو اشاعة الفقر وانعدام التكافل وابتعاد المشرع الوضعي عن تاسيس قيم روحية في قلوب الافراد لبناء المجتمع بناء عقائديا رصينا على قاعدة المبادئ الاسلامية والايمان بالله.
ان التدابير الوقائية هي الاجراءات الجزائية التي تتخذ لغرض معالجة النزعة العدوانية للمجرم من اجل عدم تكراره ارتكاب الجريمة ، وهي نتيجة لذلك تهدف الى حماية المجتمع من الخطورة الاجرامية وحماية افراده ..وتتخذ نوعين من الاجراءات، تدابير وقائية شخصية و تدابير وقائية عينية، حيث نصت عليها المادة (١٠٤) من قانون العقوبات العراقي بأنها: "التدابير الاحترازية أما سالبة للحرية أو مقيدة لها أو سالبة للحقوق أو مادية.
حاول المشرع العراقي تطوير اساليب الوقاية من الجريمة المالية واصلاح السلوك الاجرامي وردع الجاني من خلال فهم الدوافع الاجرامية وكيفية معالجتها،الا ان ازدياد الجرائم المالية بشكل متسارع في العراق بسبب التحولات الاجتماعية والسياسية المتسارعة ،وانتشار الفقر والعوز والمرض والجهل ، الذي ساهم في الابتعاد عن النهج الاسلامي في التربية والتوجيه والعقاب ، جعل المشرع العراقي قلقا لذلك يطرأ على القوانين تغييرات مستمرة .وهذا ماجعلها تمتاز بعدم الثبات.
ان المشرع العراقي والتشريع الاسلامي تناول كل منهما الوقاية باساليب تتشابه في حالات وتختلف في حالات اخرى ،وهما يهدفان الى مواكبة تطور الجرائم المالية. ومن الاهمية في الوقت الحاضر ان نستثمر تلك المقارنات بين التشريع الاسلامي والتشريع العراقي،وصولا الى وقاية فاعلة تنسجم مع طبيعة المجتمع وسبل وقايته من هذه الجرائم المستشرية المتعاظمة اثاراها على مصالح الافراد واستقرار المجتمع.

Money is considered one of the fundamental interests that require protection in man-made laws and Islamic law, because money is indispensable for the continuation of life, and Islamic law has made the status of one who is killed in defense of his money a martyr. The seizure of individuals’ money, whether it is without the owner’s consent, such as theft, or with his consent, using fraud, deceit, fraud, breach of trust, or fraud, is detrimental to the safety and stability of society. Therefore, financial crimes lead to the collapse, disintegration, and backwardness of many societies. Due to the legislator’s inability and lack of seriousness. To prevent it. What contributes to the increase in financial crimes is the spread of poverty, lack of solidarity, and the positive legislator’s move away from establishing spiritual values in the hearts of individuals to build society in a solid ideological manner based on Islamic principles and faith in God.
Preventive measures are the penal measures taken for the purpose of treating the aggressive tendency of the criminal in order to prevent him from repeating the crime. As a result, they aim to protect society from criminal danger and protect its members. Two types of measures are taken: personal preventive measures and in-kind preventive measures, as stipulated in Article (104) of the Iraqi Penal Code states that: “Precautionary measures are either depriving of freedom, restricting it, depriving of rights, or material.
The Iraqi legislator tried to develop methods of preventing financial crime, reforming criminal behavior, and deterring the offender by understanding criminal motives and how to address them. However, financial crimes are rapidly increasing in Iraq due to rapid social and political transformations, and the spread of poverty, destitution, disease, and ignorance, which has contributed to the move away from the Islamic approach. In education, guidance and punishment, the Iraqi legislator was concerned about the laws being constantly changed. This is what made them characterized by their lack of stability.
The Iraqi legislator and Islamic legislation each deal with prevention in methods that are similar in some cases and different in others, and they aim to keep pace with the development of financial crimes. It is important at the present time to make use of these comparisons between Islamic legislation and Iraqi legislation, in order to reach effective prevention that is consistent with the nature of society and ways to protect it from these increasingly widespread crimes and their effects on the interests of individuals and the stability of society.

  ان ادلة الاثبات الجزائية هي الركيزة الاساسية التي تعتمدها العدلة في تحديد مرتكب الفعل الجنائي ويعتمد عليها حكم القاضي، كما ان توفر الادلة دون تمحيص وتحري وتحقيق لا يكفي لاصدار الحكم. فكم من بريء ادلى باعتراف على نفسه وهو لم يرتكب الفعل المنسوب له بدوافع الاكراه او اليأس او التضحية.

تطورت وظيفة المحاسبة والحاجة الى خدمات المحاسب عبر ثلاث مراحل رئيسة تمثلت بوصف المحاسبة اداة لخدمة كل من أصحاب المشروع والإدارة والمجتمع . وطالما ان المحاسبة وليدة ظروف قانونية واقتصادية واجتماعية ، فانه يمكن القول ان تغيير هذه الظروف يتطلب اعادة النظر في المبادئ العلمية والعملية التي تتضمنها المحاسبة.
تهتم وظيفة المحاسبة في تقديم الخدمات العلمية والفنية الى جهات متعددة ومتنوعة من المستخدمين لمساعدتهم في عملية أتخاذ قرارتهم التشغيلية والادارية والمالية . وتتجسد هذه الوظيفة المحاسبية في القيام بتسجيل وتبويب وتلخيص الاحداث والانشطة الاقتصادية التي تقوم بها الشركات من خلال تقديم الكشوفات والتقارير مالية.
وعليه يتعين على المهتمين في المجال المحاسبي ان يقوموا بدراسة وافية لمفردات المحاسبة المالية على شكل مراحل متتابعة ومتناسقة تكون فيها مبادئ المحاسبة هي المرحلة الاولى لإعطاء فهم وتصور واضح في الاساسيات التي تقوم عليها مبادئ المحاسبة ، فضلا عن دراسة عمليات التسجيل والترحيل والترصيد واعداد الكشوفات والتقارير المالية باستخدام مجموعة كبيرة من التمارين التطبيقية.
الأمر الذي يجعل من الجانب التطبيقي الى جانب الاطار الفكري عامل يساعد الطلبة الدارسين والمهتمين في اكتساب المهارات الكافية لامتهان المحاسبة وكيفية الاستفادة من مخرجاتها بالاتجاه الذي يتناسب مع التطور التكنلوجي الحديث. اذ ان الجانب النظري الذي تبنى عليه مبادئ المحاسبة المالية لابد ان يتعزز بالجانب الالي (الحاسوب) الذي اصبح السمة السائدة للعمل المحاسبي في عالمنا المعاصر.
يتناول هذا الكتاب الجمع بين المبادئ النظرية والتطبيق العلمي من خلال النظرة المعاصرة لمشاكل عمليات الشركات التجارية وإيجاد التطبيقات العديدة لمعالجة هذه المشاكل، علاوة على أن هذا الكتاب تم إعداده بطريقة علمية تتفق مع المستوى العلمي المطلوب لطلبتنا الأعزاء في التعليم الجامعي.

The accounting function and the need for accountant services have developed through three main stages, represented by accounting being a tool to serve project owners, management, and society. As long as accounting is the product of legal, economic, and social circumstances, changing these circumstances requires reconsidering the scientific and practical principles included in accounting.
The accounting function is concerned with providing scientific and technical services to multiple and diverse users to help them in the process of making their operational, administrative and financial decisions. This accounting function is embodied in recording, classifying and summarizing the economic events and activities carried out by companies by submitting financial statements and reports.
Accordingly, those interested in the accounting field must conduct a comprehensive study of the terms of financial accounting in the form of successive and consistent stages in which accounting principles are the first stage to provide a clear understanding and vision of the basics on which accounting principles are based, in addition to studying the processes of recording, transferring, balancing and preparing financial statements and reports using a large group of applied exercises.
This makes the practical aspect, along with the intellectual framework, a factor that helps students studying and interested in acquiring sufficient skills to practice accounting and how to benefit from its outputs in a direction consistent with modern technological development. The theoretical aspect on which the principles of financial accounting are based must be enhanced by the automated aspect (computer) that has become the prevailing feature of accounting work in our contemporary world. This book deals with combining theoretical principles and scientific application through a contemporary view of the problems of commercial companies' operations and finding numerous applications to address these problems. In addition, this book was prepared in a scientific manner that is consistent with the scientific level required for our dear students in university education. 

يعيش الناقد هادي نهر عوالم الشاعر نضال القاسم في تجربته الإبداعية المميزة على مدى سنوات طوال أصدر فيها مجموعاتٍ ملأت هذا الكتاب الطريف. لقد أبحر الناقد الهادي مع الشاعر القاسم في عُمقِ تجربته الشعرية المتصارعة على الحياة والوطن، والمتشابكة في عوالمها كالأرض المجروحة المخذولة ، بلغة إيحائية منتقاة الألفاظ والصور والمعاني لتتلاءم مع العمق والظلال، أملا في فجر جديد، ومكان ظليل. لا شك أن الناقد قد سعى لاختراق طبقات الشعر في تكوينه الإبداعي البعيد؛ مبتدئا من مشاكسة أرضه إلى رماد مدنه عند ليله الذي قد لا يمحوه نهاره مسافات تتباعد، وآمال تقترب من الوصول، عاشها الناقد الضمني في ردهات شعرٍ يحمل بعضًا من هالات التكوين القارة، والمتحركة نحو الضياء، والأحلام مع الطين والماء الأنيق كي يستقر ويلامس آمالا عراضًا، وأحلاما طافحة في نجمة بيضاء، وفصول أربعة.

تتباعد الأرواح والمسافات بين الشاعر العاشق للأرض، ونبضات الناقد الحاني عليها بعد أن وطئتها قدماه يوما، حتى لاحت له في ذكراها لهفة ندية، وتوق لذيذ لما فيها من أزهار وأقمار يتبارى في عشقها النشامى. من هنا وهناك تُطوى المسافات، ويعود الناقد إلى أرض الشعر مُطِلًا بشموخ وكبرياء على الجليل والبطل الصغير، والحجر النبيل. تغيبُ المسافات الحارقة لتطل من خلفها مزارع الأمل وأغنيات المجد، وتاراتُ الوطن. ولما كانت الحياة نصاً مفتوحا يملؤه الشاعر بالأمنيات وبالجراح، فقد غدا الناقد يعيشه من ثم بدهشة النصّ المظنون وبلاغات القول المشحون؛ بحرارة التوق، وجمرة العشق، وخفقة القلب. وهكذا أحكم الناقد مبضع النبش في الأحرف المضيئة ليقف على تجذر المعنى، واكتمال
الصور، وتحليق الخيال، وحلاوة الإيقاع الناظم لكل ما تصنعه نغماته المنتقاة. وانتهى إلى أن غاص في طبقات اللغة يُقدِّرُ للشاعر زراعة الحياة الآملة رُغم عُنف الصراع، وطهر الدماء. لا شك أن الناقد أُعجب بمهارة الشاعر وفنيَّته المنجزة فيما رصدته القصيدة القاسمية من إبداع تتجلّى فيه

Thus, the critic has perfected the scalpel of digging into the luminous letters to stand on the rootedness of meaning, the completion of images, the flight of imagination, and the sweetness of the rhythm that organizes everything that his selected melodies create.
