  ان ادلة الاثبات الجزائية هي الركيزة الاساسية التي تعتمدها العدلة في تحديد مرتكب الفعل الجنائي ويعتمد عليها حكم القاضي، كما ان توفر الادلة دون تمحيص وتحري وتحقيق لا يكفي لاصدار الحكم. فكم من بريء ادلى باعتراف على نفسه وهو لم يرتكب الفعل المنسوب له بدوافع الاكراه او اليأس او التضحية.
